Minister of DHA Extends Exemption Permits for Lesotho and Zimbabwean Nationals

In a recent press release (1 December 2023), the Minister of Home Affairs in South Africa, Dr. Aaron Motsoaledi, announced the extension of exemptions granted to Lesotho and Zimbabwean nationals residing in the country.


The background of this decision traces back to fourteen years ago when the Minister introduced exemptions for Zimbabwean nationals, acknowledging the predominant economic migration status among this group and the need to ease pressure on the asylum system. Subsequently, approximately 178,000 Zimbabwean nationals were granted exemptions permits. This initiative mirrored a similar process that began in 2015 for around 54,000 Lesotho nationals whose visas are expected to expire on 31 December 2023.


Section 31(2)(b) of the Immigration Act grants the Minister of Home Affairs the authority to provide specific categories of foreigners with rights of residency for specified or unspecified periods, considering unique circumstances justifying such decisions. The Minister deliberated on various factors, including impending permit expirations, ongoing litigation, budgetary constraints, and the socio-economic engagements of the affected populations in South Africa, among other pertinent considerations.


The Minister has issued directives which immediately extend both the Zimbabwean and Lesotho exemption permits until 31 December 2024. During which time ZEP and LEP holders must apply for the extension of their visas at VFS Global, who have been given instructions to expedite the application process. The extension permits will be issued until 29 November 2025.


The conditions outlined for the new exemption permits include entitlements for work, conducting business within South Africa, and sojourning rights within the country during the permit's validity.


The Minister confirmed that applicants who have already applied for waivers or mainstream visas do not need to apply for the above extension permits as they have been afforded certain protections whilst they await the outcome of their waiver and visa applications.
